What is an Uncontested Divorce?

Divorces can messy, time consuming, and expensive. Mediation or collaborative divorces can still be an emotional drain on everyone involved; however, there are alternatives. In our legal system, the only way to avoid going to trial is to settle out of court. If both parties agree on all essential issues, an uncontested divorce can be efficient and cost less overall.

A divorce is not considered “uncontested” when both spouses agree they want a divorce. Couples must agree on how to divide their assets, how to handle marital debt, and if they have children, how they will split custody and child support. Uncontested divorces work best when both spouses have the same objective and do not want to spend a lot of money undoing their decision to say, “I do.” In an uncontested divorce, the judge is only asked to approve your decisions—not settle an argument between spouses.

Just because you are getting divorced doesn’t mean there needs to be a winner and a loser. While most separating couples could fill out the paperwork and submit it to the court, I can provide advice and custom tailor the documents to your situation. The duration of an uncontested divorce will also depend on the county’s Superior Court. Some counties place uncontested divorces on non-jury calendars that could take several months for a final decree to be granted, while others address uncontested divorces nearly daily.
